I applied in Dec 2007 through a nonMara agent. I was issued an AL in Jan 22, 2008. My IELTS results were forwarded in April before I turned 45.

The ASPC email used to have this : RECEIPTING AND ACKNOWLEDGEMENT OF APPLICATIONS

Adelaide Skilled Processing Centre is currently receipting new applications within service standards. Once an application has been receipted it undergoes validity checking and an acknowledgement letter with client information and a receipt will be sent. If an application is determined to be invalid documents will be returned and a refund of the visa application charge arranged.

I had been refused because of technicality or negligence of my agent to lodge without IELTS. If my application underwent validity checking (as to completeness?) before the AL was issued in Jan. 08, I could have relodged but at this time, it is no longer an option as I am already overaged.

Can justification be an option in this case? I am no longer after the refund but only to have my application considered due to age requirements. Please advise.

Sorry to inform you that no more justifications will be useful now. The law stated that you should lodge the application before you turn 45 years of age, which is expired in your case.
If you are married and your spouse is under 45 Yrs of age and in SOL, then this will be your only hope.
